Goodlatte: Lawsuits, Defunding May Be Used Against Ammo Ban

House Judiciary Committee Chairman Bob Goodlatte told Fox News he is preparing a bipartisan letter for President Barack Obama over his administration's plan to ban a popular rifle ammunition.

But if that doesn't work, the White House can expect lawsuits and defunding, he said.

Goodlatte, a Virginia Republican, said he plans to get 100 signatures on his letter from both Democrats and Republicans before sending it to Obama next week.

A federal proposal announced this month would ban M855 AR-15 green tip ammo by revoking its "armor-piercing" exemption. The National Rifle Association and other Second Amendment supporters have criticized the decision.

"The president has tried to ban this rifle, but Congress has refused," Goodlatte said Thursday on Fox News Channel's "The Kelly File."

"Now it appears he's taking his pen and cell phone and, through the ATF, is trying to ban the second most popular ammunition that is used in that rifle."

The ammunition is popular with sports shooters, and Goodlatte said it has not been used in an attack on law enforcement in a decade.

Though armor-piercing bullets are banned, the ammo is among some that have been granted exemptions. A public comment process is planned, but Goodlatte isn't satisfied, saying the proper procedures weren’t followed.

"They're doing it in a way that appears to violate the Administrative Procedures Act. They're not doing it out in the open in a public process. So we're concerned," he told Fox News.

"And there is no assurance that when these public comments are made that those comments will be made public," he said. "So it's not, in our opinion, the proper way to go about doing this. It's a bad idea to begin with. They're not following the law."
