Groups Plan to Challenge Texas Abortion Clinics Law

Pro-abortion rights groups are asking the U.S. Supreme Court to overrule last week's decision by the U.S. Court of Appeals for the Fifth Circuit that temporarily allows Texas to enforce new restrictions on abortion clinics, Politico reported.

Texas has required abortion clinics to have admitting privileges at local hospitals and meet standards of ambulatory surgical centers.

With the law upheld, of the 41 facilities in the state, fewer than 10 remain operational, the Houston Chronicle reported.

"Women's constitutional rights and access to safe, legal abortion care have been dealt a devastating blow," said Nancy Northrup of the Center for Reproductive Rights.

Her group plans to challenge the Texas Fifth Circuit ruling.

"We look now to the U.S. Supreme Court to immediately reinstate the injunction, allow the clinics to reopen and put an end to the irreparable and unjustifiable harm to Texas women that is happening right now," Politico reported.

Lower federal courts have been divided on the issue. If the Supreme Court takes the Texas case, or a similar one, it would be able to map out the extent to which a state can regulate abortion without violating the spirit of Roe v. Wade, the 1973 case which tied abortion to the constitutional right to privacy, according to Politico.

Other cases involving abortion could also come before the court, including those challenging laws that require clinics that conduct non-surgical abortions using drugs to have surgical centers.

Not everyone is convinced the Supreme Court will intervene in the Texas case.

Former Solicitor General Paul Clement, who served under President George W. Bush, expects the court to apply "a relatively rigorous application" in considering the problem posed by divided lower courts.

"I don't see a sort of appetite to reach out and take those cases," he said, Politico reported.
