'The Interview' Distributed Eventually, But Lawyer Not Sure How

"The Interview" will be distributed and Sony Pictures "had no choice" but to delay the movie’s release, an attorney for the entertainment company told "Meet the Press" on Sunday.

“They had a choice, they just chose not to release it. Is that correct?” the show’s host Chuck Todd asked David Boies, attorney for Sony Pictures Entertainment.

“Well, not really. You can't release a movie unless you have a distribution channel,” Boies said. “The theaters were subject to threats of physical violence against the theaters and against their customers. And quite understandably, a large number of them, a majority of them, decided not to show the picture when it was scheduled. When that happened, Sony really had no alternative. Nobody was stepping up.”

Boies said that a few people like George Clooney stepped up to discuss the issue, but “none of the second guessers who are now out there saying, ‘Oh, what a terrible thing this is,’ none of them were standing up to help Sony then.”

When asked by Todd whether he believes Sony would be liable if violence occurred in a theater showing the movie, Boies said he didn’t know.

“What I know is, when you have physical threats against people's lives, and there wasn't anybody — these threats were public, OK? There wasn't anybody stepping up when those threats were made and saying, ‘Oh no, we're going to take care of this. We're going to protect the public. We're going to make sure that nothing happens there,’” Boies said.

And ultimately, he added, “Whether it's a legal liability or not, I think you just have to be very careful with people's lives. And remember, Sony only delayed this. Sony has been fighting to get this picture distributed. It will be distributed. How it's going to be distributed, I don't think anybody knows quite yet.”

This week, President Barack Obama said Sony should not have backed down and pulled the movie, and said he wished the company had talked to him before making that decision.
