Republican lawmaker Randy Boehning of the North Dakota House was outed this week in retaliation for voting down a gay rights bill by a Bismarck man he chatted with online and previously sent an explicit photo.

"The 1,000-pound gorilla has been lifted," the Fargo representative told Inforum.com on Monday. "I have to confront it at some point."

Boehning was outed by Dustin Smith, 21, who he met on the gay dating smartphone app called Grindr. He said a few people knew about his orientation, but most did not.

Smith realized that Boehning was a legislator after Inforum published the pictures of every representative who voted against Senate Bill 2279 on its front cover earlier this month.

"I’m sure I’ve talked to this person before," Smith remembers thinking to himself, he told The Washington Post in a telephone interview. "Suddenly it dawned on me: I think I’ve seen this guy on Grindr!" 

That's when Smith contacted the media, showing them the chats they'd had, as well as the penis picture Boehning sent him on March 12. Boehning's profile nickname was "Top Man!" and his bio read, "Seems I haven't found mister right yet, so need to keep looking for and having fun on the way! Hit me up boys."

Smith thought it was hypocritical that Boehning voted against SB 2279, which would have expanded discrimination protections. Yet, even after being outed, Boehning stood by his vote.

He said the bill's language needed to be cleaned up (it would've protected people "perceived" to be gay), adding that he votes based on his constituency — not how he feels personally.

"This has been a challenge for me," Boehning said. "You don't tell everyone you're going to vote one way and then switch your vote another way — you don't have any credibility that way."

On Tuesday, the top Republican leader in the North Dakota House, House Majority Leader Al Carlson, stood by Boehning

"This is news to most of us, and what Randy does in his private life is his own business and he’s a good legislator," Carlson said. "And we will defend the work that he’s done as a legislator for his district because he’s done a good job."

Boehning alleged during the outing ordeal that he was previously threatened with being outed by a Capitol employee ahead of the vote. Carlson has promised to investigate that claim on Boehning's behalf.
