NYPD Cop Takes Cash From Man; DA Investigating (Video)

An unidentified New York City cop was caught on video allegedly taking $1,300 from a man while searching him at Coney Island, and the Brooklyn district attorney's office is investigating the incident.

Detectives started looking into the allegation after the video emerged showing an unidentified officer putting his hand into the pocket of Lamard Joye, according to the New York Post. The video shows the police officer pulling out what looks like papers as the Brooklyn construction worker is being held against a fence after midnight on Sept. 16.

"Give me my money, man! Give me my money," a man identified as Joye can be heard saying on the video. His attorney, Robert Marinelli, told the New York Post that the officer then pepper-sprayed his client.

"The cops thought they could just go in his pockets, take his money, Mace him and leave," Marinelli told the Post. "If there wasn't a video, nobody would believe this happened."

The attorney told the tabloid that the officer also pepper-sprayed Joye's sister, Lateefah Joye, who protested the incident at the scene. Lateefah Joye had asked for the officer's shield number.

WNBC-TV reported that Joye was never arrested in the incident and Marinelli told the television station that his client just wants his money returned and does not plan to sue the city at this time.

"I think that the police thought probably Mr. Joye did not get the money honestly and that they could get away with this and nobody would ever ask any questions," Marinelli told the television station.

Patrick Lynch, president of the Patrolmen's Benevolent Association, told the New York Daily News that he believed the video of the incident was inconclusive.

"A 35-second-long video does not provide enough information about a police encounter to come to any conclusion about what transpired," Lynch told the newspaper.

The Daily News reported that last year people filed 198 complaints against officers involving the use of pepper spray to the Civilian Complaint Review Board in 2013, down slightly from 208 in 2012.
