Mary Nunes, Scott Kelley Held After Being Missing for Decade

Mary Nunes, who disappeared more than a decade ago in the middle of a custody dispute, was taken into custody by U.S. marshals with her stepfather Scott Kelley when they arrived by plane in Atlanta from Costa Rica.

Nunes, 19, and Kelley were met by at Hartsfield-Jackson Atlanta International Airport where Kelley was arrested while Nunes was transported to an undisclosed location in Colorado.

Nunes was the focus of a bitter custody dispute in New Hampshire in 2004 between her mother Genevieve Kelley and her father Mark Nunes. Kelley claimed that Mark Nunes had sexually abused the girl, reported the Union Leader.

Genevieve and Scott Kelley disappeared with Mary Nunes after police and the courts discounted the abuse claims.

Genevieve Kelley turned herself into U.S. authorities in November on charges of custodial interference, reported WMUR-TV. She claimed she left the country with her daughter to protect her from her father.

Genevieve Kelley's lawyer said her defense will center around the failure of Mary Nunes' court-appointed guardian and social service agencies to believe her about the abuse and to protect her.

"Simply put, there was no lawful alternative to provide safety for this child," said Alan Rosenfeld said in court documents.

Mark Nunes, who hasn't seen his daughter since she was 8, said in a statement he was hoping to see her soon but worried about her emotional and physical state, noted the Union Leader.

"We love Mary and are overjoyed that she is alive and back in the U.S.," said Mark Nunes. "Our hearts and home are open to her, and we will do everything we can to ensure she remains safe and healthy."

The search for Mary Nunes covered the United States, Canada and South America, reported CNN. Scott Kelley and Mary Nunes appeared at the U.S. Consulate in Costa Rica this week to get passports back to the United States.
