Tax Lawyer Kleinfeld: Rand Paul Should Take Over IRS

Sen. Rand Paul should be tapped to become IRS commissioner, because only a "die-hard reformer" will be able to get to grips with the agency's fundamental problems, tax lawyer Denis Kleinfeld tells Newsmax.

"Whoever administers the agency will have to understand its fundamental flaws," said the co-author of the two-volume treatise "Practical International Tax Planning."

Those flaws began from the agency's inception, claims Kleinfeld in an interview with Newsmax TV.

"It was put in not because someone said because it's going to be very efficient or it's going to raise taxes very well. It was put in to tax the rich and that's exactly what it was put in for.

"The concept of being fair has always been a political weapon and as the years have gone by, it's been fairly evident," he said.

Kleinfeld, who is based in Miami, called for the elimination of the entire income tax system and said it should be replaced by consumption taxes, otherwise there will always be people and groups targeted unfairly.

"It just strikes you like what's happening now is … an inherent part of this income tax system and therefore the only way to eliminate what's going on now is to repeal the income tax system."

Kleinfeld, a strategic tax and wealth protection attorney, said he does not buy the claim that a couple of rogue employees in an office in Cincinnati were responsible for the targeting of tea party and other conservative groups.

"The way it works with the IRS is that lower level employees don't do anything at all unless they're told. There are no rogue employees that just go start up files because there no mechanism, there's no way they could get those into the system.

"The way it works if you're a low-level employee is cases come in, they're sorted in a different office, and then those files are then handed to an agent and said, with a check list, do this."

Kleinfeld agrees with GOP calls for a special prosecutor to be appointed, "considering the attorney general has already been held in contempt by Congress."

The agency's faults will also make the implementation of Obamacare impossible, he added.

"There is no way of maintaining security of people's medical and psychological records or restricting the amount of billions upon billions of dollars of fraud in a system they were going to rush to put together for which no one understands," he said.

"I never felt it would happen. Now, when you look at the lynchpin of the Obamacare is the IRS. If the IRS is not trustworthy, then the mechanism of having Obamacare completely disintegrates."

"To say we're going to do better and we're going to enforce the law and so on and so forth — obviously, over the last hundred years, this is the mantra we've been hearing and look where we are now."
