Hall and Oates Cereal Lawsuit: Haulin' Oats a Trademark Infringement

Hall & Oates is suing the makers of Haulin’ Oats Cereal over its play on words that closely resembles the popular band’s name.

Attorneys for Daryl Hall and John Oates, singers of the hits “Rich Girl” and “Private Eyes,” say Early Bird Foods & Co. is infringing on the band’s trademark.

“The name and mark Haulin’ Oats is an obvious play upon Plaintiff’s well-known Hall & Oates mark, and was selected by defendant in an effort to trade off of the fame and notoriety associated with the artist’s and plaintiff’s well-known marks,” the New York Post quoted the lawsuit.

The lawsuit said this wouldn’t be the first time such a connection has been made between Hall & Oates and oat-related products.

Early Bird advertises Haulin’ Oats as “rolled oats and maple syrup,” and calls the cereal a “back-to-basics flavor.” It sells three bags of the products for $27 on its website.

Early Bird was founded by Nekisia Davis and is based in Brooklyn.

According to the company website, Early Bird’s granola sells around the world in Europe and Japan, and in 38 states in the U.S.

Hall and Oates have been touring together for years, but they haven’t released an album since 2006 and they don’t really plan on recording together again.

“We've grown into a place where we're very individualist, more than we ever were," Hall told Billboard. "We are our own people. I don't think either one of us has a desire to sit in a room and try to write a song with the other guy; we didn't even do that that much through our career. … It's just one of those things; people move on, time moves on, people develop, they grow as people, they become more individualistic as they grow older. All those factors are contributing to the separateness of it."
