"Fallout 4" maker ZeniMax is being sued over its song use in violence commercials.

The maker of video game "Fallout 4" is being sued by singer-songwriter Dion whose song "The Wanderer" is used in a trailer for the game.

The lawsuit, filed in California, says Dion DiMucci (better known as simply Dion) wasn't given the chance to speak with game maker ZeniMax about how his song was used. He did license "The Wanderer" for "Fallout 4" commercials, but says he wasn't consulted about the violence in the "repugnant" trailer that features "repeated homicides in a dark, dystopian landscape, where violence is glorified as sport."

"In 'The Wanderer,' Dion gives life to the story of a sad young man who wanders from town to town, not having found himself or the capacity for an enduring relationship. The song describes isolation during coming of age," the lawsuit states. 

"Without Plaintiff’s consent, Defendants dubbed 'The Wanderer' into commercials in which the protagonist, a wanderer, roams from one location to the next, armed and hunting for victims to slaughter," it continues. "Defendant’s Commercials have no redeeming value, they simply entice young people to buy a videogame by glorifying homicide, making the infliction of harm appear appealing, if not also satisfying."

According to the lawsuit, Dion would have requested changes to the commercial to show the "story of a post-apocalyptic struggle for survival without craven violence."

Dion is seeking more than $1 million in damages for the "Fallout 4" commercials.
