Aiyana Stanley-Jones: Officer Who Killed Girl Won't Be Tried Again

A Detroit police officer will not face a third trial after he shot and killed 7-year-old Aiyana Stanley-Jones during a raid in 2010.

The county prosecutor’s office said it would not seek a third trial for Officer Joseph Weekley in the girl’s death after the first two trials ended in hung juries.

"Today we personally informed the family of Aiyana Stanley-Jones that we have made a decision that we would not be going to trial for a third time," Wayne County Prosecutor Kym Worthy said in a statement, the Detroit Free Press reported.

During the second trial, Judge Cynthia Gray Hathaway dismissed the felony charge against Weekley, saying there wasn’t enough evidence for the case, a situation Worthy told the Free Press was “unfortunate.”

The judge’s directed verdict cannot be appealed, he said.

Weekley and other members of the Special Response Team entered a home in the middle of the night where Aiyana was sleeping on a couch in the front room with her grandmother. The team was looking for a murder suspect. Weekley’s gun apparently went off by mistake.

After the second mistrial, Weekley issued a statement, quoted by My Fox Detroit, that said, “No matter the outcome of any jury's decision, I have already been devastated and my life has been ruined irreparably by the events that occurred on May 10, 2010. There has not been one single day that has gone by since that day where I have not thought about the loss of Aiyana and I will be haunted by this tragedy for the rest of my life."

Ron Scott, a spokesman for the Detroit Coalition Against Police Brutality, told the Free Press he is attempting to get the U.S. Department of Justice to file federal civil rights charges against those responsible for the raid. He questioned the fact that the raid was conducted at night.
