Judge Tosses Patent Claim Against Nintendo

REDMOND, Wash. -- A judge has dismissed a patent-infringement lawsuit against Nintendo over the company's Wii video game machine.

The order from U.S. District Court Judge Manuel Real in Los Angeles comes less than six months after the lawsuit by Guardian Media Technologies Ltd. was filed.

The claims against Nintendo are part of a bigger lawsuit against retailers and electronics makers over parental-control technologies that Guardian Media has patented.

The judge ruled that Nintendo did not infringe Guardian Media's patent.

"At the earliest stages of this case, Nintendo convinced the court to dismiss this case as Guardian's patent had nothing to do with Nintendo's products," Rick Flamm, senior vice president of legal and general counsel for Nintendo of America, said in a statement.
