Markey: Dems Will Reverse Nuke Option on SCOTUS

Sen. Ed Markey, D-Mass., said Democrats will reinstitute the ability to filibuster Supreme Court nominations the next time they are in charge.

"When the Democrats return to the majority and capture the presidency — which we will, that day is going to arrive — we will restore the 60-vote margin," Markey told MSNBC on Monday. "We will ensure that for the Supreme Court there is that special margin that any candidate has to reach, because that is essential to ensuring that our country has a confidence in those people that are nominated rather than just someone who passes a litmus test."

Markey's comments came the same day Neil Gorsuch was sworn in as the high court's newest justice. Senate Republicans last week invoked the so-called "nuclear option" to defeat a threatened Democrat filibuster that would have required Gorsuch to receive 60 votes for confirmation.

Democrats gained the 41 votes needed mostly over their consternation Republicans refused to hold hearings last year for President Barack Obama's nominee Merrick Garland for the same seat left open by the death of conservative Justice Antonin Scalia in February 2016.

Democrats first employed the nuclear option for lower court nominees in 2013 to keep Republicans from blocking Obama's nominees.
