Coons: Senate Will 'Take Steps' Against Trump Attempt to Replace Sessions

The Senate will take action to keep President Donald Trump from replacing Attorney General Jeff Sessions in a recess appointment, according to Sen. Chris Coons, D-Del.

"Before we go out on recess, we're going to take steps to make sure that the president doesn't have the ability to make a recess appointment," Coons said Thursday on CNN's "New Day."

Recess appointments can only happen if a recess is 10 days or longer, Coons noted.

In these appointments, the appointee avoids a Senate confirmation hearing and then serves through the end of the year.

The only way Republicans formally adjourn for recess is with an adjournment resolution that Democrats can filibuster, which they have been doing to prevent Trump using a recess appointment, according to CNN.

"One of the few powers the minority has is to set the terms of adjournment in negotiation with the majority," Coons said, referring to Democrats, who are in the minority in both houses of Congress.

Coons said some conservative Republican senators would be against Sessions' firing.

"I think there's been some strong pushback both in defense of Attorney General Sessions by his friends and former colleagues here. And I think you will see some tough work by Democrats to make sure that the president doesn't have a window to make a recess appointment," the senator said.

"I think that's a good thing that we're working in a bipartisan way to make sure that we're following the regular order and that the Senate isn't cut out of its constitutional role of advice and consent," he added.

Trump has discussed privately the possibility of using a recess appointment to replace Sessions if Sessions leaves, according to a Wednesday report in The Washington Post.

Coons also discussed the issue Wednesday on MSNBC's "Morning Joe."

"Attorneys general pledge their loyalty to the United States Constitution, not to an individual president, and President Trump doesn't seem to understand that," Coons said.
