Rand Paul: Pence Sitting in on Senate AHCA Vote Would Help

The solution to the American Health Care Act stalemate could be Vice President Mike Pence, according to Sen. Rand Paul, R-Ky.

According to The Hill, the Kentucky Republican floated an idea Thursday a "firm commitment" Pence would preside over the Senate — and be the one making decisions about what can be included in the bill — would help reassure conservative House lawmakers their changes will not be stripped out by the Senate's parliamentarian.

What could help the House reach a deal and pass the bill is "if President [Donald] Trump and Vice President Pence made a public declaration that they are willing to make the vice president sit in the chair, and have the vice president make the judgment on what is allowable under Senate rules," he said, per The Hill.

Sen. Ted Cruz, R-Texas, has been pushing the idea as well, arguing Pence could expand the scope of the legislation by effectively overruling the parliamentarian – and bulk up the legislation with measures supported by conservatives.

"Are we going to let the parliamentarian decide what should be in the bill, or are we going to let the vice president?" Paul asked, The Hill reported.

Paul suggested he was worried if conservatives included a repeal of Obamacare's insurance mandates in the House bill, the Senate parliamentarian would strip them out because of the "Byrd rule," The Hill reported.

According to The Hill, to pass the Byrd rule, legislation using the reconciliation process must be primarily focused on addressing the deficit; only provisions that have a budgetary impact might be included.

Sen. John Cornyn, R-Texas, said he is "deeply skeptical" of Paul's suggestion.

"The Byrd rule is not just a precedent, it's not just a rule of the Senate, it's a law," he told The Hill, adding: "What we need to do is spend our energy and time trying to build consensus around something that can pass."
