Rudy Giuliani: Fox Reporter Should Sue DOJ for 'Totally Unethical' Behavior

Former New York City Mayor Rudy Giuliani accused the Obama administration of being “extremely incompetent” on Tuesday as he urged Fox reporter James Rosen to sue the Justice Department for libel after being named an unindicted co-conspirator in the government’s zealousness to hunt down an information leak.

“That is almost impossible to have happen. I can’t imagine how you would name a reporter as an unindicted co-conspirator when all the reporter was doing was their job,” insisted Giuliani, who spent 15 years in the Justice Department as both a U.S. Attorney and Associate Attorney General. “The reality is the obligation is on the government employee. They take the oath of office. They’re the ones who have the obligation not to leak sensitive or classified information.”

He called the treatment of Rosen “totally unethical” and added, “I think it’s illegal.”

Appearing on Fox’s “Hannity,” Giuliani also said embattled IRS official Lois Lerner, who oversaw the division accused of targeting tea party and conservative groups for added scrutiny, must be aware of some “criminality” if she elects to take the Fifth Amendment rather than testify before Congress.

“The reality is that can’t be used against her in a court of law, but we certainly have the right to draw the inference that there is some criminality involved here,” said Giuliani. “Otherwise she wouldn’t be taking the Fifth Amendment.”

He said that the Fifth Amendment, which protects Americans from self-incrimination, still requires that the individual have a concern before it is invoked. “There has to be some concern that you can be incriminated,” he explained. “There is criminality here. Otherwise she wouldn’t be invoking the Fifth Amendment.”

President Obama’s triple plate of scandals — including the IRS misuse of power, the Justice Department’s investigation of Rosen and other journalists, as well as the possible cover-up of the Sept. 11, 2012 attack on the diplomatic mission in Benghazi, Libya — appear to be part of a wider pattern of abuses, according to the former mayor, who served during the 9/11 attacks on his city and Washington, D.C.

“How can you miss the fact that there’s a pattern here?” Giuliani asked. “It seems to me that the people in this administration got the signal from the top. You know go after these people. It’s like “Murder in the Cathedral" when Henry II said ‘rid me of this meddlesome priest.’ And then they went out and killed (Archbishow Thomas) Becket.”

At a minimum, Giuliani said, the president must try to explain all three scandals to the American people.

“The president has got to explain all of this. It’s got to come from the president,” he asserted. “Exactly what did he know about Benghazi? Where was he? Why weren’t forces sent there as they should have been? Why wasn’t security supplied in advance? Why did the IRS do this? Why does information in his White House never seem to get to him?”

Giuliani also raised the possibility that the Obama administration may have a so-called “enemy’s list” much like the list that was purportedly kept during the Nixon years.

“We need an explanation from him so we can trust him,” said Giuliani. “Now we’ve gotten to the point where I can’t imagine anybody’s going to trust anything they say because the next day it turns out to be false. It’s up to him. He has got to straighten this out.”
