Legal Analyst Callan: Contraceptive Rule Tough Issue for Court

The Supreme Court's decision to consider whether for-profit companies whose owners oppose abortion on religious grounds must obey the Affordable Care Act's mandate of birth control coverage will have the court tackling a complex, controversial issue that varies from state to state, says CNN legal analyst Paul Callan.

"The reason the Supreme Court is looking at it is the 10th Circuit, which is a federal court that covers a good portion of the western United States, has ruled one way … and another court, the Third Circuit, which covers New Jersey, Delaware, Pennsylvania, went the other way," Callan told "The Steve Malzberg Show" on Newsmax TV.

"So we've got different laws in different parts of the country [which] the Supreme Court has to straighten it out."

One of the issues is whether a corporation can be considered a person with religious beliefs.

"I find it hard to believe that the court would go that far, because I mean let's face it, if a corporation has a religious belief, it would be in money," Callan said.
