Republican presidential candidate Jeb Bush told Newsmax TV on Tuesday that while President Barack Obama can name a new Supreme Court justice, the task should fall to a new commander-in-chief.

"The president has every right to nominate a Supreme Court justice," he told "Newsmax Prime" host J.D. Hayworth, "and the Senate has every right to either not hear that case or to reject it out of hand.

"In any case, this should not be decided in an election year," the former Florida governor said. "This should be an election-year issue.

"There's a lot riding on it: the Second Amendment, religious freedom. Many other cases are riding on who gets to appoint this Supreme Court justice.

"Antonin Scalia is an inspiration," Bush said. "He's a lover of liberty and of protection of limited government — and someone in that vein should be the next Supreme Court justice."
