McCarthy: Illegals Are 'Law Enforcement Problem'

Illegal immigration is a "law enforcement problem" – a distinction from national security that has been "lost" since 9/11, according to former federal prosecutor Andrew McCarthy.

The new Trump administration should be targeting incentives for illegal immigration, McCarthy, a contributing editor for the National Review, told Newsmax TV host Bill Tucker on "The Steve Malzberg Show."

"If I could give them one piece of advice, it is that immigration is essentially a law enforcement problem not a national security problem," he said. "I think sometimes after 9/11 we've kind of lost that distinction a little bit, and the way that you deal with a law enforcement problem is you manage it with sensible law enforcement . . . target the magnets . . . like the illegal hiring, go after the really bad offenders, change the incentives to come to and overstay in the United States, and then let it play itself out, and let's see what happens."

Yet, McCarthy said, the Trump administration has so far exceeded his expectations.

"I expected to spend most of the time annoyed," he said. "So far, I've spent most of the time in a pretty good mood. I think particularly just even this week with the immigration piece –which is not nearly as radical as you would think if you just read coverage – [is] what I hoped for, which is restore the law of the United States, and I think if that's the trajectory we stay on, this could be very successful."

McCarthy also defended resigned National Security Adviser Mike Flynn, asserting "I don't see any legitimate reason for [the FBI to be] investigating him."

"He's obviously not an agent of a foreign power, there's no basis to think that he committed any criminal offense," he added.

"To the extent that the Russians may have thought that whatever countermeasures they were taking were defeating our ability to do surveillance they now know that it didn't – and they have to step up their efforts which is going to make it that much harder for our honorable intelligence officers."
