Alan Dershowitz: Facebook Torture Crew Faces Tough Legal Defense

The torturing of a mentally-disabled teen by four monsters who allegedly aired the horrific violence live on Facebook is an "open and shut case" of racial hatred and sheer stupidity — one very hard to defend in court, renowned civil-rights lawyer Alan Dershowitz tells Newsmax TV.

"Since there's no inconsistency between something being based on hate and stupidity. Hate is often based on stupidity and ignorance," Dershowitz said Friday to J.D. Hayworth on "Newsmax Prime."

When you have a situation where people are yelling racial epithets and at a disabled person, there are two reasons for it to be a hate crime. Number one, racial, and the other, if you attack people based on disability it can be a hate crime as well.

"So, this is a very open and shut, clear case of an assault which is at least in part based on race and that's enough to qualify under the statute."

Jordan Hill, 18; Tesfaye Cooper, 18; Brittany Covington, 18; and Tanishia Covington, 24, were charged with aggravated kidnapping, hate crime, aggravated unlawful restraint, and aggravated battery with a deadly weapon for allegedly cutting the scalp of the 18-year-old disabled man, while punching and kicking him and forcing his head into a toilet, authorities in Chicago told The Chicago Tribune.

The suspects were seen on the Facebook Live video screaming racial comments and obscenities about President-elect Donald Trump, per the Tribune. The suspects are all African-American.

Dershowitz, a Harvard Law School professor emeritus, said defense lawyers have little to work with.

"The defense would be stupidity — these are just young people who took the first target of opportunity, it wasn't racial, it was just based on their anger. I don't think that would prevail but that would be the only defense that would be available to them," Dershowitz told Hayworth.

"It just shows the depths of depravity that some people could sink to and we've seen similar video tapes over the years or at least we know of similar cases where white thugs have done it to people of color, of Muslims.

"And what we're seeing going on now in White Fish, Montana with Nazis parading with guns attacking Jews and we saw it against Catholics in the South during the Klan period."

Dershowitz said the nation is plagued with so much racial hatred and religious hatred that "we have to make sure we vigorously enforce the law any time there's a situation like this regardless of what the racial component happens to be, whether it's a black victim or a white victim."

"The law has to impose itself equally without regard to race and it was very disturbing to see some black commentators on television — not justifying this of course, nobody could justify it —but saying, well you know, you have to understand and it's not really based on race, it's based on anger over Trump," he said.

"You know, blame it on Trump, that's going to be a very easy thing going forward, but that's not an answer. He's the president of the United States, we have to take that as a given and deal with whatever anger there is and make sure that we prosecute people if they're motivated by racial animus, as these four, at least in part, seem to have been."

Dershowitz is author of the book "Why I Left the Left, but Couldn't Join the Right: The Case for a Return to the Vital Center," which will be published in March by Harper.
