Rep. Messer: Obamacare Gives Firms Reason to Hire Illegals

Obamacare will give an incentive for employers to hire illegal immigrants with legal status over U.S. citizens, a situation that could significantly affect jobs because of President Barack Obama's Nov. 20 executive order on immigration, said Rep. Luke Messer.

When Obamacare's employer mandate takes effect in 2015, large companies will have to offer healthcare insurance to each of its full-time employees, or face a $2,000 penalty.

Messer told Fox News' "America's Newsroom" the fine does not apply to illegal immigrants with legal status, because they are not eligible for Obamacare.

"Under Obamacare, you have to pay a $2,000 fine if you don't provide health insurance to the employees that you hire. Because these illegal immigrants are not eligible for Obamacare, an employer who hires them won't have to pay that $2,000 penalty.

"Yet another unintended consequence of this law, and another example of what happens when you don't follow the Constitution," the Indiana Republican said Wednesday.

Messer said Obama's amnesty plan would also allow illegal immigrants access to Social Security and Medicare benefits, even though Obama said they would not be eligible for those government programs.

"This is another example of the president saying one thing and doing something else. He said that these folks wouldn't be eligible for benefits. Now, it becomes clear that those who pay into Social Security, if they are here lawfully, are eligible for Social Security benefits. So, millions of folks here in violation of the law may be eligible for Social Security," he said.

Lawmakers would face a challenge to "keep these programs fiscally sound," adding it "makes no sense" to allow access to those benefits without considering the "long-term consequences."

When Republicans assume their majority in Congress in January, Messer expected lawmakers would "first do everything we can to stop this president's executive order" on immigration.

"We could fix the problems. Beyond that, I think we need to fix the immigration system, too. We need to start with border security. We need to pass common sense reforms in the visa work program," Messer said. "That sort of deliberate, common sense, focused approach will make sure we don't have unintended consequences."
