Sen. Jeff Flake: Wait Until After November Election to Decide on Justice

Sen. Jeff Flake is willing to meet with President Barack Obama's Supreme Court pick Merrick Garland, but he still thinks that his fellow Republicans are doing the right thing by demanding that any confirmation occur after the November election.

"I think that Republicans are doing the right thing, we're fully justified in saying let's wait until after the election, to actually nominate somebody or approve the president's nomination," the Arizona Republican, a member of the Senate Judiciary Committee, told Fox News' "Fox and Friends" program.

With that said, he favors taking a look at the nomination during the lame duck session following the November election, if the eventual Republican nominee loses and Democratic front-runner Hillary Clinton wins.

"I would rather have a less-liberal nominee like Merrick Garland than a nominee that Hillary Clinton, if she were president, would put forward."

But still, said Flake, he's willing to meet with Garland, because he's said from the beginning he'd meet the eventual SCOTUS nominee and he'll stand by that.

Also on the program, Flake unveiled his 'Egregious 8' government waste tournament, serving up his bracket of eight incidents of extreme government spending.
