Democratic nominee Hillary Clinton has been declared in default by the court after she failed to respond to a wrongful death lawsuit brought by the parents of two of those killed during the 2012 attack on the American consulate in Benghazi, Libya, The Hill reports.

The designation means she was served with court documents and did not answer the complaint, and that she will now have to respond in some manner or risk that a judge could rule automatically in favor of the plaintiffs.

Larry Klayman, the lawyer who brought the suit, said Clinton's failure to respond is evidence that she "doesn't care about our clients."

Patricia Smith and Charles Woods claim in the suit, as LawNewz reported, that the attack that killed their sons and two other Americans was the direct result of Clinton's negligent use of a private email server, because "Islamic terrorist obtained the information sent and received by [her] about the location of Ambassador Christopher Stevens and thus the U.S. Department of State and the covert CIA and other government operations in Benghazi and used it to plan, orchestrate and carry out the horrific and devastating attack."

The Republican-led special House committee probing the attacks, however, filed a report in June that found no new evidence of wrongdoing by Clinton.

Clinton spokesman Nick Merill expressed deep sympathy for the families, but emphasized that "there have been nine different investigations into this attack and none found any evidence whatsoever of any wrongdoing on the part of Hillary Clinton."
