House Intelligence Committee Vice Chairman Adam Schiff said Tuesday that former National Security Adviser Michael Flynn has declined to testify before or supply business documents to his panel and — as such — "we do have to explore a use of contempt."

"We are going to be entertaining the same options in terms of our subpoena," the California Democrat told Wolf Blitzer on CNN. "There are court decisions that may provide a limited Fifth Amendment right in terms of document production, but it is only limited.

"It was our preference initially to get these documents and testimony voluntarily," Schiff added. "It's now going to be necessary to subpoena it — and if the general refuses, and does so without a legal basis, I think we do have to explore a use of contempt."

Flynn, 58, whom President Donald Trump fired in February over concerns about his disclosures of Russian contacts to Vice President Mike Pence, has said that he would invoke his Fifth Amendment rights in testimony before the Senate Intelligence Committee in its investigation.

Schiff told Blitzer that the House panel was refining its subpoenas to Flynn to obtain his business information.

"We've started out in the hope that the witnesses that we've invited would come in and cooperate voluntarily," he said. "I'm sure that a great many will.

"Obviously, some won't — but we don't go into this presuming with most of these witnesses that we're going to have to fight to get their testimony and documents.

"But we will be vigorous and have to be in getting the information," Schiff said.

"Our next step is to tailor our subpoenas with best chance of success, but we'll be doing our own legal research to find out what steps are necessary if we have to go the route of contempt."
