Nebraska Abortion Laws and How They Compare Nationally

The state of Nebraska has some of the strictest laws in the country when it comes to restrictions on abortions.

Nebraska passed landmark legislation in 2010 when the state banned abortions after 20 weeks of pregnancy. Since then, 12 other states followed suit, prohibiting the procedure after the same period of time: Alabama, Arizona, Arkansas, Georgia, Indiana, Idaho, Kansas, Louisiana, Mississippi, North Dakota, Oklahoma, and Texas.

Wisconsin only recently joined these states ranks when Republican presidential contender and current Gov. Scott Walker signed the ban into law in July 2015. Emergency abortions are excluded, similar to the rule in Nebraska.

Like a majority of the states, Nebraska requires abortions to be done by a licensed physician, but it does not necessitate that the procedure be done in a hospital, unlike 20 other states across the country.

Just over half the states in this nation have waiting periods following consultations on having the procedure. Nebraska’s waiting time is 24 hours, which is the most common, although some require as much as 72 hours.

Individuals with some of the most regulations are girls under the age of 18. Minors require written and signed consent for a parent or guardian to have the procedure performed in Nebraska. About half of the United States requires some sort of parental agreement for a minor to have an abortion.

Several states necessitate that the parent is notified that the operation is going to happen by the clinic or individual performing the surgery.
