Idaho Gun Laws Provide Interesting Case Nationally

Idaho is among a handful of states that have passed legislation making it illegal to enforce federal gun laws. These laws have been created by states to keep the federal government from having too much control over their Second Amendment right to bear arms.

Following states such as Kansas and Alaska, which passed nullification laws a few years ago, Idaho agreed in March 2014 to make it a misdemeanor to enforce a federal gun law, with a possible fine of up to $1,000.

In the past 10 years, more than 200 bills have been introduced in state legislatures around the country targeted at nullifying federal gun laws. These bills have resulted in 11 bills being passed in nine states. However, there were three bills vetoed by the governors of Missouri, Montana, and Oklahoma.

The nullification bills and laws taking hold across the country, including in Idaho, indicate that some states to be left alone to determine how to interpret the Second Amendment.

Many states, especially those in the West and South, are firm believers that allowing people to defend themselves is vital to safety. That belief differs somewhat from some in the federal government, as well as many other states.

In 1999, there were a few hundred thousand concealed gun permits nationwide. Today, there are more than 10 million permits. In Idaho alone, there are approximately 87,000 permits to carry concealed weapons.

Balancing the right to bear arms with the belief that more gun control is necessary to protecting the lives of all citizens will continue to be a thorny debate at both the national and state levels.
