North Dakota Gun Laws: How Do State Laws Apply in Oil Boom Area?

Gun laws can be a hot-button topic and in the state of North Dakota, it is not different, especially with the oil boom in the western part of the state which has brought money and thousands of jobs to this rural area near the Canadian border.

However, it has also significantly increased drug dealing and other crimes, straining law enforcement resources. But even with the challenges presented, state leaders are not considering gun law changes in a state that takes a conservative approach to gun control.

Federal prosecutions in the Bakken Shale fields have tripled, from 126 in 2009 to 336 in 2013, mostly due to drug crimes, U.S. attorney Tim Purdon told Fox News.

Drugs such as heroin and methamphetamine aren't the only concern, though. Murders, aggravated assaults, rapes, human trafficking, and robberies connected to those drug sales are also on the rise. Sen. Heidi Heitkamp (D-ND) has initiated a task force of North Dakotans to focus on that increase.

She doesn't toe the Democratic line on gun laws, as she voted to block expanding background checks for gun buyers.

"I made a judgment call that [the proposed law's] main purpose was to put more restrictions on law-abiding gun owners as opposed to really capturing criminals," she told The Daily Beast.

The oil fields are near Williston and the Fort Berthold Indian Reservation, an area with a lower law enforcement presence than needed to cope with the crime wave. Heitkamp told The Washington Post she wants to persuade the state to address the lack of roads, housing, and police.

For the most part, however, the state government has taken a fairly hands-off approach to the oil fields. North Dakota ranks as a conservative state that takes a dim view of raising taxes and fees on its citizens.

An article in The New American cited the state for low government spending, debt, and taxes, along with relaxed gun laws.

Most local governments don't have the power to regulate firearms and ammunition, and North Dakota gives local law enforcement some judgment in granting concealed carry permits, according to the Law Center to Prevent Gun Violence.
