Companies can offer free firearms in sweepstakes or gun giveaway contests. There are multitudes of these companies using contests to draw traffic to their retail websites, physical stores, gun related publications, or firearm related organizations.

For example, in 2013 the Firearms Policy Coalition ran a gun giveaway contest, called Stop the Gun Control Madness, in an effort to gain the support of gun advocates to their cause. The National Rifle Association is running a long-term giveaway in an effort to recruit new members, and the publication Gun Digest has ongoing High Caliber Sweepstakes in which entrants can win various firearms and accessories.

All of the gun giveaway contests have readily available sweepstakes rules that include information on how to enter, the odds of winning, how the winner will be determined, tax information regarding the value of the firearm, and legal information in the event of a dispute. In addition, sweepstakes rules provide information about the use of the winner's identity for publicity purposes and in the case of gun giveaway laws, rules that clearly state important eligibility requirements as they relate to taking possession of a firearm.

Winners of gun giveaways are responsible for knowing their state gun laws including age and residency requirements and they must be able to pass a background check. For example, typical eligibility requirements taken from the NRA Sweepstakes official rules state that, "Any gun prize winner must conform to all local, state, and federal regulations as applicable and must make arrangements for delivery of firearms with appropriate federally licensed firearms dealers as required by state and federal law."

While companies can give away guns, the actual transfer of any firearm as a prize must be done through legal channels. A common legal clause in gun giveaway sweepstakes rules states, "Transfer of the prize shall be conducted through a federally licensed Federal Firearms License (FFL) dealer. All firearms transfers will be conducted in strict compliance with all applicable federal, state and local laws. By entering this sweepstakes you acknowledge that you are not legally prohibited from owning or taking possession of firearms."
