Roy Black Calls for Probe of Rush Prosecutors

Florida attorney Roy Black is calling for a special investigation into possible felonies committed by the Palm Beach state attorney's office during its probe of "doctor shopping" allegations against top radio host Rush Limbaugh.

Complaining about allegedly illegal leaks emanating from State Attorney Barry Krischer's office, Black told Fox News Channel's "Hannity & Colmes" that Krischer's handling of the case warranted a criminal probe.

Reading from Florida law, Black cited a statute that makes it a crime "to misuse the information gathered as a result of the investigation" into Limbaugh.

Black argued that the state's constitution made an investigation imperative, telling Sean Hannity: "Pursuant to the Florida constitution, the elected state attorney has a constitutional obligation to enforce these laws. ... If they don't want to do an investigation of themselves, they should turn it over to some other agency to investigate."

Black said he had asked Krischer's office for an investigation into his office's leaks weeks ago, noting, "We have not yet received the courtesy of a reply."

The Limbaugh lawyer said that politics were driving the probe, complaining that Krischer's office was "aware for ten months about these accusations about Rush and prescription pain medication" but that "they had no interest in him" at the time.

"In fact, when I first talked to them," said Black, "they said: 'Look, we don't prosecute people who are in situations like that. We encourage them to seek rehabilitation.'"

But after the National Enquirer sensationalized the story, he said, Krischer's office changed its mind.

The "sole reason" for the probe, said Black, "is to discredit Rush because of his personal and political opinions."

"What better way to discredit somebody than to keep the investigation going, keep the leaks going and keep his name in the press regarding accusations like this."

Black suggested that prosecutors would rather continue to smear his client than actually test their case in court.

"It's a lot more difficult to bring a charge and actually try it in court where a person has a chance to defend themselves," Black told "Hannity & Colmes."
