Sarah Palin is urging Congress to “rescind” the tax penalty provision of the Obamacare mandate requiring all Americans to obtain health insurance, saying the Supreme Court has done the country a favor by putting the Affordable Care Act back “in the hands of the people.”

“What Chief Justice [John] Roberts did for us . . . was put this issue — Obamacare, and the individual mandate — back in the hands of the people via our representatives,” the former Alaska governor said Thursday on Fox News’ “On the Record with Greta Van Susteren.”

“So now . . . Congress has an opportunity to act on this tax, as this has been deemed a tax [by the court ruling],” she said, adding, “After the July recess, I expect Congress to come in and rescind this tax. They have the power to adopt and enact a tax. They also have the power to rescind it.”

Palin, a Fox News contributor, also said she expects Republican presidential nominee Mitt Romney to make good on his promise to repeal Obamacare if he wins the White House in November.

“First on the list of priorities must be repealing and replacing Obamacare with something that makes more sense,” she said.

Palin also used her appearance with Van Susteren to send a message to governors, calling on them to opt out of the Medicaid expansion provision in Obamacare.

“Many, many states are not going to be able to afford expansion of Medicaid and these [health insurance] exchanges that are going to try to be forced down states’ throats . . . I would like to see governors be tough and opt out of this,” she said.
