Law Stripping Planned Parenthood Funds Stands

Planned Parenthood Request to Hold up Indiana Law Denied
A day after Gov. Mitch Daniels signed a law that strips Planned Parenthood of Indiana of federal funding, a judge Wednesday denied the agency’s request to put the law on hold.

So as it prepares to challenge the measure in court, the agency will receive no Medicaid reimbursements for the next six weeks, The Indianapolis Start reported Thursday.

planned, parenthood, fundingU.S. District Judge Tanya Walton Pratt denied the agency’s request for an emergency hold on the law. The same judge also will hear the agency’s argument on whether the law is constitutional.

"I'm pleased that the state law is going into effect as the Legislature intended," said state Solicitor General Thomas M. Fisher.

Pratt said that letting the law take effect for six weeks would not cause "immediate and irreparable injury, loss or damage."

The hold on the law would have covered the period until July 1. By that date, Pratt said, she will decide whether the state should enforce the law during the months it will take to hear Planned Parenthood's case.

Pratt noted that Planned Parenthood has other funds that helps cover costs.
Daniels signed the law Tuesday, making Indiana the first in the nation to cut off Planned Parenthood from Medicaid funding. That amounts to about $1.3 million a year in Indiana.
