Report Vindicates Former Kan. AG, Abortion Opponent

A Kansas disciplinary board for lawyers hid an internal report that found no probable cause for ethics complaints against the state’s embattled former attorney general, The Topeka-Capital Journal reported Wednesday.

Phill Kline has been accused of ethical breaches that occurred during his years-long investigation into abortion providers, including George Tiller, who was killed in 2009. Kline is appearing before a three-attorney panel that sits as the Kansas Board for Discipline of Attorneys for a hearing.

Kline told the newspaper that the report could have helped him during his losing bid in 2008 to stay on as Johnson City district attorney. The report also would have helped him counter the accusations that he overstepped his authority during the investigation, he said.

Kline became attorney general in 2003. Soon after, he began his investigation into abortion providers. He continued the investigation when he became district attorney in 2007.

Kline questioned why the disciplinary administrator was continuing the hearing and ethics complaints against him when the report found no probable cause to do so.

The 2006 and 2007 ethics complaints were filed by attorneys representing Planned Parenthood and George Tiller. They arose amid a “hotly contested political race,” the report said.
