Cornyn: Lawsuit Could Be 'Body Blow' to Obamacare

Texas Sen. John Cornyn is filing a friend of the court brief in a doctor's lawsuit seeking to overturn Obamacare.

Dr. Steven Hotze, CEO of Hotze Health and Wellness Center, is suing over the employer mandate in the Affordable Care Act. The Department of Health and Human Services and Secretary Kathleen Sebelius are the defendants.

"Obamacare is the worst piece of legislation that has been passed in the last decade, or maybe 25 years," Hotze said Thursday on Fox News Channel's "Your World with Neil Cavuto."

The law is destroying small businesses like his own because they can't afford the increased insurance. Businesses will end up dropping insurance for employees, or they'll have to go on exchanges, and they won't be able to afford it, Hotze said.

"So it's going to do just the opposite of what it intended to do," he said. "If you wanted to devise a plan to destroy small businesses you couldn't come up with a better plan than Obamacare to do that."

Hotze spoke at length with Newsmax in July about the lawsuit.

Cornyn, a Republican, told Cavuto that his friend-of-the-court brief will focus on the legality of the law. The Supreme Court in June upheld the ACA. Chief Justice John Roberts defended the ruling in his majority opinion, saying the penalty imposed on those not having insurance is essentially a tax, and therefore under Congress' authority.

Cornyn, among others, contends that ruling makes the law unconstitutional because revenue-raising bills must originate in the House of Representatives. The ACA originated in the Senate.

"This could well be a body blow to Obamacare," Cornyn told Cavuto.
