House Oversight Committee Chairman Jason Chaffetz, R-Utah,  said Tuesday he may call FBI Director James Comey to testify before his committee after his announcement earlier in the day that he would not recommend prosecution of former secretary of State Hillary Clinton.

Chaffetz's panel has been investigating Clinton's use of a private email server while in office, and told Fox News Channel's "Special Report" that Comey's office has up to now not been forthcoming with the information it has because the investigation was pending.

"Now that it's closed there's no excuse not to provide that information to Congress," Chaffetz said, who said he talked to Comey after he made his public statement earlier in the morning, but that Comey was not very talkative about what he was willing to share.

"I can issue a lot of subpoenas, a lot of requests," he said. "If they're unwilling to prosecute these, what are you telling the rest of the government? That's probably the biggest long-term consequence that I fear."
