Commentary Magazine's Tobin: Grant Lerner Immunity

The only way to get the real facts behind the IRS' illegal targeting of tea party groups seeking tax-exempt status may be to grant former IRS official Lois Lerner immunity of prosecution, Jonathan Tobin, senior online editor of Commentary magazine, says.

"If the House wants to find out or at least have a chance to find out, they're going to have to cut some kind of deal with her," Tobin told "The Steve Malzberg Show" on Newsmax TV.

"I know that sticks in everybody's craw because she was just so brazen when she appeared before the House, and her record is so terrible."

This week, two House panels voted to hold Lerner in contempt for her refusal to testify about what she knows about the targeting scandal. They want Attorney General Eric Holder to consider criminal charges.

Lerner, who has asserted her Fifth Amendment rights against self-incrimination, has said she will only testify about the IRS handling of tea party cases with an immunity agreement.

"My point is if our object is just to complain about Lois Lerner, then let's just go on complaining," Tobin said.

"But if we want to have a chance — [and] there's no guarantee because she could lie, but she'd be lying under oath, and then she would really be in peril — that's the only chance of finding out what's going to happen here."

Tobin added that if Lerner was granted immunity and did not tell the truth under oath, she would be "in big trouble, and even Eric Holder would have to prosecute."
