It will be next to impossible for former Obama administration officials called to testify about an alleged Benghazi cover-up to invoke executive privilege, retired U.S. Army Major Gen. Paul Vallely says.

"Executive privilege should not work because none of them are in office in the administration at this time. That will not work, in my opinion," Vallely told "The Steve Malzberg Show" on Newsmax TV.

"They will certainly safeguard Hillary Clinton as much as they can, but if they lie, it's a felony offense, and they could go to jail, or should go to jail.''

Story continues below video.

House Speaker John Boehner announced he is calling for the formation of a select committee to probe the Benghazi attack and an alleged cover-up by the administration.

Critics say the administration misleadingly blamed an anti-Islamic video for inciting the attack instead of a planned terrorist operation in order to avoid political fallout.

Earlier this week, Vallely told Newsmax he believes if a cover-up is ultimately found, it is grounds for the impeachment of President Barack Obama.

"When a chief executive, when our commander in chief absolutely deceives the American public the way he has and his people have, then he should step down immediately, as well as those people involved that are still in office," he told Malzberg.

Vallely also predicts further Russian intervention in Ukraine, following the deaths of numerous pro-Russian rebels in a crackdown by Ukrainian troops in the Slovyansk.

"Putin is going to do what he wants to do, and they're very, very brutal," Vallely said.

"Once they go on an offensive operation just like they did with the Chechens and so it's going to get worse.

"Unless Ukraine is supported somehow, they will fall to Russia, and it goes beyond Crimea now. Putin has his horns out; he is ready to take over the Ukraine. That was his goal right from the beginning, for me it was just a way to get there."
