Dr. Sanjay Jain: ACA Court Ruling Raises Questions

By Courtney Coren   |   Wednesday, 23 Jul 2014 04:31 PM

Doctors and patients have a lot of questions in the wake of the Obamacare ruling by the D.C. appellate court that said Americans cannot get healthcare subsidies through the healthcare exchange marketplace run by the federal government, says Dr. Sanjay Jain.

"Not only do patients have questions, doctors and healthcare providers, they all have questions themselves," Jain told Ed Berliner on "MidPoint" on Newsmax TV on Wednesday.

"We're getting back to square one," he added.

According to the U.S. Court of Appeals for the D.C. Circuit, Americans can only get subsidies through state-run marketplaces, but only 14 states have chosen to set up their own exchange programs.

"What this new ruling has done is actually taken away subsidies or actually ruled in a fact that these subsidies are illegal," Jain explained.

"About 4.7 million patients have actually benefited from the subsidies," he added. "So these people are now asking, 'are we going to lose our subsidies? What's next?'

"The problem is the open enrollment comes in November," Jain said.

"Now they're talking about a Supreme Court ruling in 2015, so what's going to happen from now until then to these patients who are sort of up in the air?" he asked.

"And not only patients, but doctors. People who are billing these health insurance providers trying to figure that out in terms of how are we going to fit in this new ruling?"
