“Summary Justice From Hamas in the Streets of Gaza” is the front page headline on the most recent weekend edition of The Wall Street Journal.

The Journal describes black-hooded “Hamas militants” about to “execute” tan-hooded men accused of aiding Israel “on crowded streets in the middle of the day": “Hamas militants prepare to execute an alleged collaborator with Israel in Gaza City, one of 18 executions carried out on Friday."

What The Wall Street Journal did not explain is that American courts have connected Hamas, self-defined in its charter as “one of the wings of the Muslim Brothers in Palestine,” with the Muslim Brotherhood in the United States, and that members of the U.S. House of Representatives recently introduced a bill to expose this imminent threat to our homeland.

What is our federal government doing to prevent the Muslim Brotherhood from engaging in its form of “summary justice” in our homeland? The answer depends upon what branch of our federal government you ask.

Judicial Branch. A 2010 decision of the U.S. Court of Appeals for the 5th Circuit in United States v. Holy Land Foundation, resolved that the U.S. Department of Justice, to quote the trial court, had “produced ample evidence to establish the associations of CAIR, ISNA and NAIT with HLF, the Islamic Association for Palestine (‘IAP’), and with Hamas.”

The two judicial opinions supporting these “associations” are posted along with my November 28, 2010, Breitbart article, “U.S. Court Exposes ISNA as 'Apparatus' of the Muslim Brotherhood (and Hamas): Questions Remain About the Department of Defense Continuing to Rely Upon ISNA to Endorse Chaplains.”

According to the U.S. District Court, one of the Justice Department’s trial exhibits, “‘An Explanatory Memorandum on the General Strategic Goal for the Group in North America,’ authored by Mohamed Akram of the Shura Council of the Muslim Brotherhood and dated May 22, 1991, includes a section titled ‘Understanding the role of the Muslim Brother in North America,’ which states that the work of the Ikhwan [i.e., the Muslim Brotherhood] in the United States is ‘a kind of grand Jihad in eliminating and destroying the Western civilization from within and sabotaging its miserable house by their hands and the hands of the believers so that it is eliminated and God’s religion is made victorious over all other religions’.”

Executive Branch. The executive branch appears to treat the Muslim Brotherhood and Hamas as if they are not both committed to the same “grand Jihad in eliminating and destroying the Western civilization from within.”

We now know, thanks to a recent disclosure under the Freedom of Information Act, that “The Obama administration conducted an assessment of the Muslim Brotherhood in 2010 and 2011, beginning even before the events known as the ‘Arab Spring’ erupted in Tunisia and in Egypt.

"The President personally issued Presidential Study Directive 11 (PSD-11) in 2010, ordering an assessment of the Muslim Brotherhood and other ‘political Islamist’ movements, including the ruling AKP in Turkey, ultimately concluding that the United States should shift from its longstanding policy of supporting ‘stability’ in the Middle East and North Africa (that is, support for ‘stable regimes’ even if they were authoritarian), to a policy of backing ‘moderate’ Islamic political movements.”

A Gulf News article reveals that “To this day, PSD-11 remains classified, in part because it reveals an embarrassingly naïve and uninformed view of trends in the Middle East and North Africa (Mena) region."

Legislative Branch. Under our Constitution, Congress has the power “To define and punish Piracies and . . . Offenses against the Law of Nations [and] To declare War” (Art. I, Sec. 8). On July 24, 2014, seven members of the House of Representatives introduced H.R. 5194, the ‘‘Muslim Brotherhood Terrorist Designation Act of 2014,” which would “impose sanctions against persons who knowingly provide material support or resources to the Muslim Brotherhood or its affiliates, associated groups, or agents.”

H.R. 5194 recites many of findings of the 2008 Holy Land Foundation trial, “the largest terrorism financing trial in United States history,” including the following:
  • “Department of Justice officials successfully argued in court that the international Muslim Brotherhood and its United States affiliates had engaged in a wide-spread conspiracy to raise money and materially support the terrorist group Hamas."
  • “HLF officials charged in the case were found guilty on all counts in November 2008, primarily related to millions of dollars that had been transferred to Hamas."
  • “During the trial and in court documents, federal prosecutors implicated a number of prominent United States-Islamic organizations in this conspiracy, including the Islamic Society of North America (ISNA), the North American Islamic Trust (NAIT), and the Council on American-Islamic relations (CAIR)."

H.R. 5194 already has 15 co-sponsors in the House. This is a good start.

According to its website, “CAIR is America's largest Muslim civil liberties and advocacy organization. Its mission is to enhance the understanding of Islam, encourage dialogue, protect civil liberties, empower American Muslims, and build coalitions that promote justice and mutual understanding.” That website currently advertises, “Sold Out 1st Annual CAIR-MN Social Justice Gala a Success.”

Speaking of “Social Justice,” this is how Dietrich Bonhoeffer described the "the extraordinary experiences of the 10 years since Hitler's ascension" in 1942: "The great masquerade of evil has played havoc with all our ethical concepts. For evil to appear disguised as light, charity, historical necessity, or social justice is quite bewildering to anyone brought up on our traditional ethical concepts, while for the Christian who bases his life on the Bible it merely confirms the fundamental wickedness of evil" ("Bonhoeffer: Pastor, Martyr, Prophet, Spy" (2010)).

Both Houses of the U.S. Congress should pass H.R. 5194, acknowledging the Muslim Brotherhood as a terrorist organization, whether the Brotherhood is operating overseas as Hamas, or posing an imminent national security threat within our own homeland behind the disguise of “social justice.”
