Gov. Parnell: Say No to Obamacare

Alaska GOP Gov. Sean Parnell, who Thursday said he will not enact Obamacare, told Fox News he hopes other governors who are contesting the federal law, will join with him in following the recent U.S. District Court judge in Florida’s ruling that the healthcare overhaul is unconstitutional.

parnell, alaska, obamacare“The judge gave us, along with the other states, what we asked for,” Parnell told Fox News’ Greta Van Susteren later on Thursday. “In my view, Alaska is bound by the decision. I mean, it’s a longstanding notion of judicial review: The federal courts rule –they have said this is unconstitutional. We’re not going to go forward and implement it at this point, unless there is a stay, or the Supreme Court overturns it.”

Alaska was one of 26 states party to a lawsuit, which claims Obamacare’s individual mandate requiring Americans to buy health insurance is unconstitutional. Earlier this month, U.S. District Judge Roger Vinson in Florida ruled in the states’ favor, saying because of the provision, the entire law should be struck down.

In December, the same decision was reached in a Virginia challenge In other cases, two federal judges upheld the law; another found the mandate unconstitutional, but didn't strike down the rest of the law.

The federal government is appealing the cases where the rulings were not in its favor. Late Thursday, it filed a motion to clarify in light of Parnell’s decision, asking Vinson to make clear that states cannot ignore the new healthcare law while his ruling is under appeal.

Most legal analysts say the Supreme Court will have to sort out the legal quagmire.

Van Susteren asked whether Parnell knew if other governors of states party to the lawsuit would follow his course of action.

“At this point, I am speaking only for Alaska,” Parnell said. “The other governors have the same decision to make that I have made. This judge effectively said that his declaratory judgment is the functional equivalent of an injunction – so I don’t think there is a question, at least not in my mind.

“My view is that I would like to see the other governors join me and we will sort out the money that we have taken in the future, once this has all been unraveled by the Supreme Court.”
