Napolitano: Shooter's Girlfriend Cooperating 'to Extraordinary Extent'

(Fox News' "Fox & Friends")

It's hard to believe the Las Vegas shooter's Stephen Paddock's girlfriend, or anyone else didn't know about his plans to attack a country music festival in Las Vegas, Judge Andrew Napolitano said Thursday, but she "does seem to be cooperating to an extraordinary extent."

"She came back voluntarily," Napolitano commented on Fox News' "Fox & Friends" about Paddock's girlfriend, Marilou Danley, who had been overseas when Paddock carried out his deadly attack. "Her lawyer basically told the government ahead of time what she was going to say."

Napolitano said the FBI's best interrogators interviewed Danley for hours after her return from the Philippines, where she was as the attack unfolded, and as she is not under arrest, "they must find some credibility in her denials."

Even the word "denial" is not quite correct, said Napolitano, as she is not accused of anything but instead being asked to fill in pieces of the puzzle.

"Whatever she told them was consistent with what they expected to hear," he said.

Paddock had wired Danley's family $125,000 to buy a house before the attack, and she said she thought that was because he was breaking up with her. Napolitano said that circumstance might seem unusual, but in some other cultures, it's understandable.

"The time element fits," said Napolitano. "So in other words, when she said he sent her, he did, and he distanced her from the actual preparation in Las Vegas. Whether he didn't want her involved or whether he was afraid that she would spill the beans, this is part of his maniacal planning."

Napolitano said it may also have been that as part of Danley's culture, she did not think it was her role to interfere.
