Virginia Attorney General Ken Cuccinelli has threatened Board of Health members of possibly being denied state legal counsel and having to pay for their own defense if litigation results from them again disregarding his advice on relaxing controversial abortion clinic rules.

The warning came in a memo issues on Wednesday from the Attorney General's Office, which represents state agencies and boards, The Virginian-Pilot reports. The 15-member board of health meets on Friday to reconsider regulations for licensing such clinics.

Some board members told The Virginian-Pilot that Cuccinelli’s position had been conveyed during in-person meetings with top state health officials. Cuccinelli is a prolife Republican who is running for governor.

“I heard what amounted to, maybe not a threat, but a warning that there was a risk, exposure if we as a board acted outside our scope, our authority," James Edmondson, a board member from McLean in Northern Virginia, told The Virginian-Pilot.
